DuFoe Entertainment (known herein as “we”) operates Cult Radio A-Go-Go!, Cult TV A-Go-Go!, www.cultradioagogo.com and The CRAGG Club, which are sister internet radio and television stations, as well as an online community (The CRAGG Club) that allows members to interact and communicate with old and new friends.
While all rights are reserved for content exhibited on Cult Radio and Cult TV, participation in listening to CRAGG or watching CTAGG is open to the public and offered for entertainment value to audience members free of charge. Listeners can tune into CRAGG via our website at www.cultradioagogo.com and viewers of CTAGG can tune in via our TV page at www.livestream.com/ctagg
The CRAGG Club, on the other hand, is the online community for fans of Cult Radio, Cult TV, and Cult Radio's weekly live show Cult Radio Live, airing every Saturday night at 6 PM Pacific (9 PM Eastern) to 10 PM Pacific (1 AM Eastern). While listening to the show via our ShoutCast Feed is open to anyone, the community is a members only "fan club". Members of The CRAGG Club will get the following privileges:

As The CRAGG Club is a members only community (versus the public radio and the TV feeds), the propriety of the club and protection of the community is greatly considered when inducting new members into the community. Application and club membership is FREE.. but applicants are "screened" before being accepted. Not all applicants will be accepted. Please read the terms below for more details:
This Terms of Use Agreement, as may be modified from time to time, ("Agreement") constitutes legally binding terms and applies to your use of the CRAGG Club services. By accessing and / or using the CRAGG Club Services, you agree to be bound by this Agreement. The term "User" refers to a CRAGG Club member. You are authorized to use the CRAGG Club Services (regardless of whether your access or use is intended) only if you agree to abide by all applicable laws, rules and regulations (“Applicable Law”) and the terms of this Agreement. In addition, in consideration for becoming a Member and/or making use of the CRAGG Club Services, you understand that submitting your application for membership is an indication your acceptance of this Agreement during the registration process.
The CRAGG Club reserves the right to modify this Agreement at any time and from time to time, and each such modification shall be effective upon posting on the CRAGG Club Services. All material modifications will apply prospectively only. Your continued use of the CRAGG Club Services following any such modification constitutes your agreement to be bound by and your acceptance of the Agreement as so modified.
1. Eligibility. By using the CRAGG Club Services, you represent and warrant that (a) all registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) your use of the CRAGG Club Services does not and will not violate any Applicable Law.
2. Term. This Agreement, and any posted revision to this Agreement, shall remain in full force and effect while you use the CRAGG Club Services or are a Member. The CRAGG Club may terminate your Membership at any time, for any or no reason, with or without prior notice or explanation, and without liability. Furthermore, the CRAGG Club reserves the right, in its sole discretion, to reject, refuse to post or remove any posting or to deny, restrict, suspend, or terminate your access to all or any part of the CRAGG Club at any time, for any or no reason, with or without prior notice or explanation, and without liability. The CRAGG Club expressly reserves the right to restrict, suspend, or terminate your access to all or any part of the CRAGG Club Services if the CRAGG Club determines, in its sole discretion, that you have violated this Agreement or pose a threat to the CRAGG Club, business partners, Users and/or the public. Even after Membership is terminated, this Agreement will remain in effect.
3. Password. When you sign up and if you are accepted to become a CRAGG Club Member, you will be added to a weekly mailing list. This is how you will gain the "keys" or access to the private video chat for CRAGG Live every Saturday night. You will receive an email, weekly, a few days prior to the Saturday Live show with a unique password to enter our video chat room for that night. The password is NOT to be given out to anyone or distributed in any way shape or form. If it is determined that you "leaked" the password to others, especially non-CRAGG Club members, your CRAGG Club membership will be immediately and permanantly revoked. A new password will be distributed weekly for each live show, as well as for any special online events or screenings. All passwords are to be kept private and for the access of CRAGG Club members only! You are entirely responsible for maintaining the confidentiality of your own password. You agree not to use the registered username, email address or password of another Member at any time or to disclose your password to any third party. You agree to notify the CRAGG Club immediately if you suspect any unauthorized use of your username or access to your password. You are responsible for any and all use of your registered username.
4. Use by Members. The CRAGG Club Services are solely for the personal use of Members and may only be used for direct commercial purposes if they are specifically endorsed or authorized by the CRAGG Club. The CRAGG Club reserves the right to remove commercial content in its sole discretion. Illegal and/or unauthorized use of the CRAGG Club Services, including, without limitation, collecting usernames, and / or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or unauthorized framing of or linking to the CRAGG Club Services is prohibited.
5. User Registration. When submitting your application to the CRAGG Club you will be required to give a "registered username". Username should refer to the screen name that you will use when utilizing all CRAGG Club services, including participating in the Saturday live show video chats. Please choose your username wisely. Once you are accepted into the CRAGG Club as a member, you will be expected to log in under the assigned username when utilizing any / all CRAGG Club services whether they are hosted on Ustream, the private b-board, or other services. Users are not permitted to change their screen names / user names without previous notification to the owners / operators of the CRAGG Club. If a user does alter their screen / user name, they are subject to revokation of CRAGG Club services / membership as their identity may not be verifiable.
6. Affiliations. The CRAGG Club has certain former individuals of the Cult Radio / Cult TV community who have violated our by-laws and policies. These individuals are banned from the community and not eligible for membership to the CRAGG Club or use of its services. Also, association with select individuals is prohibited for CRAGG Club members as these certain "banned" personalities have been disassociated due to violation of the community rules or other legal implications. CRAGG Club members' public profiles on other networking sites (including but not limited to MySpace, Stickam, UStream, Facebook, Twitter, YouTube and others) will be checked before membership is approved as well as intermittantly during active membership. If it is found that you are in association with any previously banned community members, you will be issued a warning / reminder email advising you of the affiliation with the undesirable (to be notified in private email). Upon notification, you would have 24-48 hours to disassociate your profile with the said banned member (or any of their aliases). If you refuse to do so, your CRAGG Club membership will be revoked immediately with no exceptions and you will not be allowed usage of any of the CRAGG Club services. If it is reported and validated that you are in association with any previously banned community member, whether by in person affiliation, contact via phone, email, online messages or social networking site, you are eligible for review and membership revokation at any time.
7. Member Disputes. The CRAGG Club is a members only community intended for and committed to like minded fans of pop culture enjoying one anothers' company and having a place to gather and interact. It is the policy of the CRAGG Club that no infighting or bashing be allowed among the ranks of the CRAGG Club. However, if a situation / dispute does arise between you and another member, you are solely responsible for your interactions with other CRAGG Club Users. The CRAGG Club reserves the right, but has no obligation, to become involved in any way with these disputes, including determining if a party is in the wrong or has violated any of the CRAGG Club rules (including the no infighting / bashing rule) and if the CRAGG Club determines you have violated any by laws of the club, your membership can be revoked at any time.
8. Privacy. Use of the CRAGG Club Services is governed by our Privacy Policy, which is incorporated into this Agreement by this reference. It is also guaranteed that data collection including but not limited to members' names, email address, mailing addresses, and personal information will never be sold to third party services or used for profit by the CRAGG Club or it's owners. Membership information is kept confidential.
9. Disclaimers. The CRAGG Club is not responsible for and makes no warranties, express or implied, as to the User Content or the accuracy and reliability of the User Content posted through or in connection with the CRAGG Club Services or Linked Services, by Users of the CRAGG Club Services or any Linked Services, and such User Content does not necessarily reflect the opinions or policies of the CRAGG Club or it's owners / community members.
10. Other. This Agreement is accepted upon your use of the CRAGG Club Services & is further affirmed by you becoming a Member. Your agreement with the CRAGG Club will always include this Agreement at a minimum. The failure of the CRAGG Club to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is then deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
